Basic regulations
1.1. The Internet site "Buses Around the World", "BusCloud" (hereinafter — the site, Buscloud, BC), located at buscloud.org, is a non-profit private-owned educational electronic resource, providing an opportunity for Internet users who have accepted this agreement and the site Rules to upload their photo materials of bus fleet and elements of the infrastructure of bus transport of different cities of the world, as well as to comment and rate the uploaded photos. 1.2. The purpose of the website is to collect photos of buses around the world to reflect their state in the past and present, to collect and systematize text information about the route network, to maintain a database of bus fleet, to organize a competition for creative photos, and to unite fans of bus transport. 1.2.1. The website is not an official source of information and does not take a position on any political issues. 1.3. "User" (also referred to as "visitor", "participant", "author", or "you") is any person who accesses or otherwise uses the site's services (as a guest or registered user). "Administrator" is a person who has access to all site management elements. "Comment Moderator" is a person who has the right to control text messages in comments on photos. "Photo Moderator" is a person who selects and publishes photos and other graphic materials on the site. "Editor" is a person authorized to maintain a database of bus fleet in one or more bus transport systems. 1.4. The user who uses the website's services accepts all the terms of this agreement, as well as all the terms of the rules that apply to the services used by the user on this website. The fact of registering on the user's website is a full and unconditional acceptance of this agreement. Ignorance of any terms of the agreement and rules does not exempt the user from responsibility for their compliance. Failure to comply with the agreement may result in denial of access to the site's services, and in some cases, may result in civil or criminal liability under applicable law. 1.5. The user is solely responsible for all information, photos, and other materials (hereinafter referred to as "Materials") that the user uploads, receives, transmits, or otherwise makes available through the site. The administration is not obligated to remove previously published information at the user's request. 1.6. When using this website, the following user data is collected: the user name displayed on the website (which may not match the user's real name) and the IP addresses from which messages are sent. In addition to this information, a password is collected for accessing the user's account, as well as an email address. Other information may also be collected upon the user's request. The email address and IP address are only accessible to the administration. The IP address can also be viewed by moderators. 1.7. The User is responsible for the security of their login and password, as well as for everything that is done on the website using the user's login and password. 1.8. The User agrees not to offer for publication materials that are illegal, harmful, offensive to morals, infringing copyrights, materials that the User does not have the right to make available under the law or under any contractual relations, which affect any patent, trademark, trade name, trade secret, copyright or other property rights and/or copyright and related rights of a third party, the publication of which on the site is prohibited in an explicit or implicit manner by the author of these materials, current legislation or other agreements. 1.9. The user must not use the website for the purpose of sending and/or transmitting information of an advertising, commercial or propaganda nature in an uncoordinated manner. 1.9.1. It is forbidden to use the address of any Internet site as a login. To advertise own resources of similar subject matter it is allowed to use the "Links" section and/or your profile on the website. 1.9.2. It is forbidden to apply to the published photos: 1.9.2.1. Names and symbols of any legal entities; 1.9.2.2. Propaganda and political slogans; 1.9.2.3. Symbols of recognized, partially recognized, and unrecognized states (including those that no longer exist); 1.9.2.4. Symbols of political and public organizations (including those that are officially unregistered and no longer exist); 1.9.2.5. Calls for anything. 1.10. The User has no right to reproduce, repeat, copy, sell, resell, or use for any commercial purposes any parts of the software and interface elements of the site without the consent of the site administration. 1.11. The site administration reserves the right to: 1.11.1. Set any restrictions on the use of the website; 1.11.2. Terminate the service user's password and delete any user data in case of violation of the provisions of these terms of use; 1.11.3. At any time, to change this agreement and additional rules; 1.11.4. Suspend or stop providing the site's services. 1.12. The site administration provides the user with the opportunity to create a single personal account. If the user creates more than one account, the administration reserves the right to delete the user's accounts and/or refuse to allow the user to use the site. Creating collective accounts is prohibited. At the user's request, their account can be blocked. Photos and comments are not deleted during this process. It is not possible to restore an account after a voluntary block. 1.13. The User does not have the right to access any other information on the site, other than the user's own information in their account or information provided to them by other users on the site, publicly available information on the site, or information that has been explicitly authorized by the administration. 1.14. By posting their materials on the site, the user grants free permission for their further use by the site's users for personal purposes that do not involve public display and/or commercial gain: reproduction in computer memory, in the memory of a mobile cellular communication system, or other reproduction for personal purposes. 1.15. Any use of the user's published materials for commercial purposes is possible only with the relevant permission of the copyright holder. 1.16. The site's services are provided "as is." The site administration is not responsible for: 1.16.1. Compliance of the site with the user's goals and expectations; 1.16.2. Direct or indirect damage caused to the user as a result of errors, omissions, interruptions in work, deletion of files, changes in functions, defects, delays in data transmission, unauthorized access to communications and/or user data in case of technical failures, actions of intruders or when in other situations; 1.16.3. Direct or indirect damage caused to the user as a result of the publication of photographs and other materials on the site by the user or other persons; 1.16.4. Statements or behavior of any third party on the site; 1.16.5. Termination of the user's access to this site and its services; 1.16.6. Materials posted, created or published by users of the site. 1.17. The site administration is not responsible for the appropriation of other people's photos and other materials by the site's users (in other words, if a site user uploads someone else's photo and attributes the authorship to themselves), as well as for other cases of copyright infringement on materials posted by users. However, the administrators try to monitor and prevent such cases as much as possible. 1.18. Users can choose a license to protect their copyright when uploading photos. However, text materials (database, information about the route network) are not protected by copyright, as they are not the result of creative work and do not contain new ideas, but only systematize publicly available data and user observations. 1.19. Geographical system of the site is created according to the United Nations. 1.20. These rules come into force upon their publication. Which vehicles are suitable for the site? 2.1. Photos and profiles of buses (diesel, gasoline, hybrid, electric, and other types of buses that do not draw power from overhead wires while in motion) are allowed on the website, as well as photos of their infrastructure, such as parks, stops, terminals, former and current sections of the route network, route network schemes (created by both users and carriers, as long as it does not violate copyright), landscape bus photography, bus tickets, meetings of website users. 2.1.1. A bus is considered to be a category D vehicle with 8 passenger seats. Photos and profiles of vakhta buses, bus cars, such as the Göppel G11, are also allowed. Photos and profiles of limousines are not accepted. 2.1.2. Photos of buses during assembly, during operation, after disposal, as well as after conversion to category B/C and before conversion to category D, are accepted. 2.1.3. In small quantities, photos of vehicles with a B/C category are accepted, when they act as a bus on the route. Profiles for such vehicles are not created. 2.1.4. The website does not accept photos and profiles of buses from the Russian Federation with police and military-type license plates (blue and black); photos and profiles of buses from the Republic of Belarus with police and military-type license plates (red 1234-MO and with a region code of -0). Buses with diplomatic-type license plates are allowed. 2.1.5. Photos depicting buses (even civilian buses) on the territory of military/special service units and bases are not accepted. The exception is public events at training grounds. Procedure for selecting and publishing graphic materials 3.1. Photos and other graphic materials for the website are selected by photo moderators. When making a decision, the photo moderator is guided by the photo selection criteria established by the administration. The final decision on whether to publish or reject a photo is made automatically based on the opinions of several photo moderators. 3.2. The user is not entitled to expect a detailed explanation of the reasons for the rejection of uploaded photos or the removal of published photos. 3.3. By submitting your photos for publication on the website, you transfer your non-exclusive property copyrights to them (the right to publish or authorize the publication of the photo in any form) to the website for any non-commercial use of the photos within the framework of the website. All manipulations with photos lawfully (at the request of the author, with the consent of the author) published on the website, such as moving them to other sections, deleting them from the website, etc., are the exclusive prerogative of the administration and persons authorized by the administration. Removing photos from the website is not encouraged; in this case, deletion is only carried out if there are valid reasons. 3.4. Photographs with significant retouching, montage (pasting) of the main objects of the shot or key moments of the scene are not allowed. If there is suspicion of retouching and the author fails to provide the original photo within 24 hours after receiving a request from the Administration, the photo will be taken down, and its participation in the Photo Contest will be canceled. Bus fleet Database 4.1. Bus fleet database maintenance is carried out by editors. 4.2. Editors are appointed by the site administration. Applications for the status of Editor are accepted through the application system in the "Database — Application for the Editor's Post" section. 4.3. Editor's responsibilities: 4.3.1. After being appointed, check the correctness of the existing data for the systems for which he/she has been appointed as an editor, and, if necessary, make corrections and additions to the lists; 4.3.2. Record known changes to the bus fleet in these systems on the website; 4.3.3. Monitor information about the bus fleet submitted by Users; 4.3.4. Review and respond to requests submitted by Users. 4.4. In the event of the entry of deliberately false or erroneous information about the bus fleet, the deletion of correct data on previously entered bus fleet and other actions leading to a decrease in the informativeness and accuracy of the site, as well as violations of other points of these rules, the editor may be deprived of editorial rights. In the event of the identification of gross violations, the deprivation of editorial rights is carried out without prior notice. 4.5. The site administration is not responsible for the information about the bus fleet specified on the site. 4.6. For entering knowingly false information about bus fleet through the Personal account, the user may be disabled the ability to offer additions/changes to the database. Text information 5.1. Text messages posted in the comments to the photos (hereinafter referred to as "Messages") are used to discuss photos and other information posted by users on the website. 5.2. In any text information posted by the User on the website (comments on photos, captions for photos, information in the profile, etc.), the following is prohibited: 5.2.1. Personal and public insults, as well as the indication and discussion of the physical and mental aspects of any user of the website. 5.2.2. Statements that explicitly or implicitly provoke racial, national, and/or religious hatred and intolerance, as well as those that offend the religious, national, and other feelings of any visitor to the website. 5.2.3. The use of obscene (expletive) words and expressions, as well as words or symbols that replace them. 5.2.4. The publication of links to Internet pages with obscene content. It is allowed to publish links to Internet pages with obscene words, but only if the page is dedicated to bus-related topics, is related to the city/specific bus, and the author of the comment warns about the presence of such words. 5.3. Any published opinion is the personal opinion of the visitor. It is forbidden to publish Messages on behalf of any group of people (ethnicity, nation) or state, except in cases where the person making the statement has explicit authority to do so. 5.4. It is forbidden to publish deliberately false information in order to mislead visitors to the website. 5.5. It is forbidden to engage in personal correspondence. Personal correspondence should be conducted using Private Messages or other means of communication. 5.6. It is forbidden to publish Messages that are meaningless or do not provide useful information ("spam"), including: 5.6.1. Messages such as "+1", "Agree", etc. 5.6.2. Messages about the number of photos of the user on the site according to any criteria. 5.6.3. Information about the users' place of residence, information about drivers, etc. 5.6.4. Comments aimed solely at drawing users' attention to their photos, including the unjustified use of comments instead of the "Note" field when uploading. 5.7. Excessive discussion of the editorial board's actions in the comments is not allowed, and complaints about the editorial board's actions are accepted in the Applications (the application is reviewed by the administrator). 5.8. Excessive discussion of the website's policy regarding the acceptance of photos and other graphic materials (messages such as "Why was this photo accepted?", "Why wasn't my photo accepted?", "I wouldn't have been accepted", "I would have received a remark '...'", etc.) is prohibited in the comments. Users can clarify their questions in the article explaining the comments on photos. 5.9. Political and ideological discussions on the site are prohibited. Active participants and provocateurs of these discussions are placed on pre-moderation, from temporary to lifelong. 5.10. In order to avoid duplication of discussions, it is recommended to familiarize yourself with previously held discussions on the subject before writing a Message, at least by viewing other discussions in the same section, as well as using search engines (Google). In the event of systematic duplication of discussions, penalties may be applied to the user. 5.11. Users are required to regularly review the news for new announcements from the administration and messages about changes on the website. Announcements about all changes in these Rules are published in the news. 5.12. Messages should be written in one of the main languages or the official language of the country (territory). However, if the message requires attention from participants from the country (territory) where the discussion is taking place, it is recommended to duplicate the local language in one of two languages: English or Russian. The use of transliteration is not encouraged. 5.13. It is recommended that replies be written in the same language as the original message, unless otherwise specified by the author of the original message. 5.14. Users are prohibited from posting messages that link to web pages that require payment and passport information to be entered immediately before viewing the content. 5.15. Moderators have the right to delete any messages without providing a reason. 5.16. For violations of clauses 5.1-5.10, the user may be subject to penalties in the form of premoderation of messages or transfer to read-only mode for a limited period or indefinitely. Ratings 6.1. Ratings serve to increase user motivation to upload high-quality and interesting materials. 6.2. With the help of ratings, site users can express their opinion about materials published by other users. 6.3. The criteria for allowing users to vote and the voting procedure are determined by the administration. 6.4. It is strictly forbidden to discuss the ratings given in the comments on photos (except for reports of malfunctions in the site's software). 6.5. For votes that are declared closed, information about users who voted and the ratings they gave shall not be disclosed under any circumstances. 6.6. In the event of user’s systematic rating (or incitement to rate), spam attacks, or comments on photographs and/or comments by certain authors by prior agreement and intent, the user(s) may be blocked from voting. Private messages 7.1. Private messages allow site users to communicate with each other. 7.2. Mass mailings (spam) are prohibited. 7.3. In the event of complaints about spam or meaningless/offensive messages from a user, that user may be blocked from sending private messages. Request system 8.1. Requests are intended for: — correction by users of information about bus fleet, photos, cities, and systems posted on the site; — reporting technical problems or disciplinary issues on the site; — requests to change personal data and user status. 8.2. Requests are divided into relevant topic groups. A request must be submitted with a topic relevant to the question. Questions that do not have their own topic in the request system are considered on the forum. Submitting meaningless requests is prohibited. 8.3. The texts posted in requests are subject to clause 5.2 of the Site Rules. |
